Alvva's services do not constitute legal advice. By using our Services, you acknowledge that you understand the limitations of our Services and that you are solely responsible for the accuracy and legality of any forms you submit to government agencies.

1Agency

A. Limited Power of Attorney

By using Alvva's Services to prepare immigration forms, you authorize Alvva to act as your agent in preparing and submitting such forms on your behalf. This authorization is limited to the preparation and submission of immigration-related documents and does not extend beyond the scope of Services explicitly offered by Alvva.

B. Scope of Authority

You acknowledge that Alvva's authority is limited to assisting in the preparation and submission of forms. Alvva does not represent you in legal proceedings, immigration court hearings, or before any government agency beyond the submission of forms. All communications with government agencies, interviews, and legal representation are your sole responsibility.

C. Revocation of Agency

You may revoke this agency authorization at any time by providing written notice to Alvva at the address specified in Section 29 (Contact Alvva). Upon receipt of such notice, Alvva will cease performing services on your behalf.

2Description of Services; No Affiliation with Government Agencies

Alvva provides a digital platform that assists users in preparing immigration-related forms and documents for submission to government agencies. Our Services include:

  • Guided form completion and preparation
  • Document organization and management tools
  • Immigration case status tracking through the USCIS Case Status API
  • Informational resources and educational materials
  • Customer support and assistance

No Government Affiliation: Alvva is an independent service provider and is NOT affiliated with, endorsed by, approved by, or connected to:

  • The United States Citizenship and Immigration Services (USCIS)
  • The United States Department of State (USDOS)
  • The Department of Homeland Security (DHS)
  • The Customs and Border Protection (CBP)
  • Immigration and Customs Enforcement (ICE)
  • Any other U.S. federal, state, or local government agency

3Limitations of Use

Your use of Alvva's Services is subject to the following limitations:

Age Requirement

You must be at least 18 years of age to use our Services. If you are under 18, you may only use our Services with the express written consent and supervision of a parent or legal guardian.

Personal Use Only

Alvva's Services are intended for personal, non-commercial use only. You may not use the Services for commercial purposes, resale, or on behalf of any other entity without our prior written consent.

Legal Purposes Only

You agree to use Alvva's Services only for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations.

4Prohibited Conduct

You agree not to engage in any of the following prohibited conduct while using Alvva's Services:

  • Violating any applicable federal, state, or local law or regulation
  • Infringing upon or violating the intellectual property rights of others
  • Attempting to gain unauthorized access to our Systems or networks
  • Disrupting the normal operation of our Services
  • Transmitting any viruses, malware, or other harmful code
  • Engaging in any form of harassment, abuse, or bullying
  • Submitting false, fraudulent, or misleading information

5Collection and Use of Your Information

Alvva collects and uses information in accordance with our Privacy Policy. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy and these Terms of Use.

6Data Collection and Usage

Types of Information Collected

When you use Alvva's Services, we collect various types of information, including:

  • Geolocation and IP address information
  • Financial information related to payment processing
  • Medical information (if included in immigration applications)
  • Basic identifying information related to your USCIS application(s)
  • Personally Identifiable Information (PII) including your USCIS receipt numbers

USCIS Receipt Numbers as PII

Important: Your USCIS receipt number is explicitly classified as Personally Identifiable Information (PII) by Alvva. USCIS receipt numbers are sensitive identifiers issued by USCIS that uniquely identify your immigration applications and cases.

USCIS Case Status API - Receipt Number Usage

Providing Alvva with your personal receipt number given to you by USCIS is voluntary. This information will only be used to retrieve your case records and provide you with updates on your case status by running searches (queries) through the USCIS Case Status API.

7Artificial Intelligence and Machine Learning

AI and ML Technologies in Our Services

Alvva may utilize artificial intelligence (AI) and machine learning (ML) technologies to enhance and improve our Services, including but not limited to:

  • Document processing and form field auto-completion
  • Automated assistance and intelligent guidance
  • Error detection and data validation
  • Service personalization and user experience optimization

User Data and AI/ML Training

No Unauthorized Model Training: User content and personal data submitted to Alvva to prepare immigration applications will NOT be used to train, improve, or develop AI or machine learning models without your explicit and informed consent.

Limitations on Automated Decision-Making

Alvva will not use AI or ML technologies to make automated decisions with legal effects on users. Any decision that affects your rights or legal status will be reviewed by qualified human personnel before implementation.

8Your Use of the Services

A. User Content

You are responsible for all content you upload, submit, or enter into Alvva's Services ("User Content"). You represent and warrant that you own or have the necessary rights to all User Content and that it is accurate, truthful, and complete.

B. Information on Services

Alvva strives to provide accurate and current information through our Services. However, we do not warrant that all information is accurate, complete, or current. Immigration laws and regulations change frequently, and you are responsible for verifying all information before submitting any forms to government agencies.

9Consent to Electronic Transactions

By using Alvva's Services, you agree to conduct transactions electronically. You consent to receive electronic communications, including emails, in-app notifications, and electronic copies of receipts and documents.

10Termination

Alvva may terminate your account and access to our Services at any time, for any reason, with or without cause, and with or without notice. Grounds for termination may include violation of these Terms of Use, submission of fraudulent information, non-payment of service fees, or inappropriate conduct.

11Special Provisions Applicable to Software

Any downloadable software provided by Alvva is licensed, not sold. Your use of the software is governed by the license agreement included with or provided by Alvva. You may not copy, modify, reverse engineer, or redistribute the software.

12Intellectual Property

All content, features, and functionality of Alvva's Services, including text, graphics, logos, images, software code, and database compilations, are the exclusive property of Alvva or its content suppliers and are protected by copyright, trademark, patent, and other intellectual property laws.

13Service Fees

Alvva offers various pricing plans and service fees. The fees for our Services are displayed on our website and application. You agree to pay all applicable fees and charges in accordance with the pricing plan you select.

14Refunds/Credits

  • 30-Day Money-Back Guarantee: If you are not satisfied with our Services, you may request a full refund within 30 days of your initial purchase, provided you have not submitted your application(s) to a government agency.
  • After Submission: Once you have submitted your immigration application(s) to a government agency, refunds are no longer available.
  • Processing: Approved refunds will be processed within 10 business days.

15RFE Support Guarantee

Alvva offers support for Request for Evidence (RFE) responses. If you receive an RFE from USCIS after submitting an application prepared through Alvva, we will provide guidance and assistance in preparing your response at no additional charge.

16Guaranteed Approval or Money Back

Alvva does not guarantee the approval of any immigration application or petition. Immigration decisions are made solely by government agencies. We do guarantee that if your application is denied due to an error made by Alvva (not due to factors beyond our control), we will refund 50% of the service fees or provide free assistance in preparing an appeal or reapplication.

17Third Parties; Third Party Content and Services

Alvva's Services may contain links to third-party websites and services. Alvva does not endorse, sponsor, or assume responsibility for any third-party content or services. Your use of third-party services is subject to their own terms of service and privacy policies.

18Disclaimer of Warranty

AS-IS BASIS: Alvva's Services are provided on an "as-is" and "as-available" basis. Alvva makes no representations or warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

19Limitations of Liability

LIMITATION OF DAMAGES: To the maximum extent permitted by law, Alvva shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages. Alvva's total liability shall not exceed the total amount you have paid to Alvva for Services in the twelve (12) months preceding the claim.

20Confidentiality of Internet Not Guaranteed

You acknowledge that the Internet is not a secure medium and that data transmitted through the Internet may be intercepted, accessed, or modified by unauthorized parties. While Alvva implements security measures to protect your information, we cannot guarantee absolute security.

21Copyright Infringement (DMCA)

Alvva respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that your copyrighted work has been infringed, you may submit a written notice of infringement to Alvva at the address provided in Section 29.

22Other Terms and Conditions

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Alvva regarding your use of the Services. If any provision is found invalid, the remaining provisions shall remain in full force and effect.

23Indemnification

You agree to indemnify, defend, and hold harmless Alvva and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

24Amendments

Alvva reserves the right to amend, modify, or supplement these Terms of Use at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Revised" date.

25Data Access Rights and Privacy

You have the right to access, review, and obtain a copy of your personal data collected by Alvva. To exercise this right, please submit a request to support@alvva.co with "Data Access Request" in the subject line.

26Dispute Resolution by Binding Arbitration

A. Agreement to Arbitrate

You and Alvva agree that any dispute, claim, or controversy arising out of or relating to these Terms of Use shall be resolved by binding arbitration rather than in court.

B. Arbitration Process

The arbitration shall be administered by JAMS or AAA in accordance with their Comprehensive Arbitration Rules. The arbitration shall take place in Santa Clara County, California.

C. Class Action Waiver

YOU AND ALVVA AGREE THAT ANY ARBITRATION OR COURT PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS, NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION.

27Changes to Agreement

Alvva may modify these Terms of Use at any time. We will provide notice of material changes by posting the updated Terms on our website and sending you an email notification of significant changes.

28Governing Law

These Terms of Use and your use of Alvva's Services are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action shall be brought exclusively in the courts located in Santa Clara County, California.
