You will need forms I-821D (Consideration of Deferred Action) and Form I-765 (Employment Authorization Document), along with additional documentation.
If your DACA expired less than 365 days ago, you can still renew it. If it has been more than 365 days, you’ll need to submit a new application for DACA, and unfortunately, USCIS is not reviewing new applications at this time. If your DACA expired less than one year ago, then you should submit your renewal application as soon as possible, and keep receipt of your renewal and most recent DACA approval on you at all times, as proof of your lawful status in the US. You should not travel outside of the US on Advance Parole until your DACA renewal has been approved.
You are not allowed to work if your DACA and Employment Authorization Document (EAD) are expired, even if you’ve already submitted your renewal. Therefore, we recommend that you plan ahead and start your renewal process six months in advance.
In many cases, you do not need a lawyer to apply renew your DACA, especially if you meet the general requirements, and have no criminal history. There are free legal resources online and from USCIS which can help guide you. With that said, working with an immigration expert like Alvva can give you peace of mind.
